Vero Beach Man Sentenced 47 Years for Child Sex Crimes

A 25-year-old Vero Beach resident has been sentenced to nearly five decades in state prison following a comprehensive investigation and subsequent plea agreement. On April 7, proceedings at the Indian River County Courthouse concluded with a 47-year sentence for crimes committed against a local child in 2023.

During the hearing, 19th Judicial Circuit Judge Anastasia Norman handed down the sentence to Mason Ty Faulkner, who was officially designated as a sexual predator by the court. The resolution of this case brings closure to the victim’s family, purposely avoiding the necessity of a traumatic trial process.

The investigation began when Faulkner, who was 22 at the time of the incident, was apprehended on June 13, 2023. Arrest reports indicate he was initially charged with the sexual battery of an 11-year-old boy. According to Assistant State Attorney Elise Kearney of the 19th Judicial Circuit State Attorney’s Office in Vero Beach, the charge was later reduced to a lewd or lascivious act on a child younger than 12 years old by a perpetrator 18 years of age or older.

This reduction was part of a strategic plea negotiation. The original charge carried a mandatory life sentence, but a key priority for the prosecution—taking the family’s input into consideration—was to protect the young victim from the ordeal of testifying in court. By securing a plea deal, the state ensured a significant prison term while prioritizing the well-being and closure of the victim’s family.

Following the initial arrest, detectives conducted an interview during which the defendant admitted to viewing child pornography on his mobile device. A search warrant executed on June 14, 2023, revealed multiple illicit images involving prepubescent and pubescent children.

The prosecution’s approach to these specific charges evolved as the investigation deepened, ensuring the strictest possible penalties under Florida law:

  • Faulkner was subsequently arrested on June 26, 2023, facing 50 initial counts of possession.
  • After Kearney was assigned to the case, the state recognized an opportunity to pursue more severe penalties by upgrading the charges from third-degree to second-degree felonies.
  • An expert thoroughly reviewed the illicit images to verify the exact ages of the depicted children.
  • On February 25, the original charges were dropped and replaced with 36 upgraded counts of possession of child pornography (10 images or more). The state proceeded strictly with the 36 counts where it could definitively prove the children involved were 12 years old or younger.

On April 7, Faulkner entered a plea of no contest and was adjudicated guilty on all charges. His 47-year state prison sentence carries a mandatory minimum of 25 years. The defendant’s legal representation from the Indian River County office for the 19th Judicial Circuit Public Defender’s Office declined to comment on the proceedings.
